The 2nd Amendment as passed by the Congress:

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

 

Is it just me, but I'm not seeing any threat to my right to keep and bear Arms, in any of the current talk about gun control. We may need a little more regulation on who can obtain guns and stricter penalties for those who miss used guns or any weapons.

Also, what is with those people who claim the 2nd Amendment is for protection from our own government, in case it really goes wrong. This is not logical. Our government now has many "weapons of mass destruction". Any body remember the Civil War. The South did not fair to well in that war. Now the government has tanks, airplanes, submarines, missiles, tactical nukes and other horrifying weapons.

I interpret 2nd Amendment as our right to aid in the defense of our country and freedom, against  threats from outside forces.

Oh yes, I'm a gun owner. We have several guns. I even have an SKS (semi-automatic clone of an AK-47) with a 30 round magazine. So if the Zombies attack, I'm ready. :-)

The 2nd Amendment has nothing to do with protection from our or any other government for at least ~100 years, today it's nothing more than our right to own a gun.  

However I think the key words in the 2nd Amendment is "A well regulated militia".  We certainly don't make up a militia with automatic and heavy weapons, and the gun nuts and the "NRA" don't want any regulation of their wannabe lookalike (semi) automatic assault weapons; they're still pea-shooters in the military scheme of things.  But against unarmed civilized people, like schoolchildren, those pea-shooters with unnecessary large magazines are a clear and present danger. They are not part of a militia nor are they regulated.  Therefore we need more regulation of non-militia wannabes that have no purpose other than to endanger the rest of us.  

Check the comments on this article from the Tea Party website. The radicle right is whipping itself into a frensey that the United States Government wants to disarm the citizens by force.

The problem is that trying reason with unreasonable people just does not work. I would bet that most of the gun nuts have never read the second amendment. They only know what the NRA and other radicals tell them.
Clearly the second amendment refers to the keeping of arms in a magazine to be used by the milita if needed to defend themselves.

I don't know how it could say that "to the keeping of arms in a magazine to be used by the milita if needed to defend themselves." Magazines didn't exist back in 1770's, everything was ball and cap with loose powder pored down the barrel...LOL

The real problem here is trade offs and political capital.  At this point, and it is going to be the major discussion on the Sunday morning news shows, will be the Biden report.  If the report can be characterized as 'get your gun' proposition, there is nothing but a fight ahead that adds to the log jam of what has to be done in the next two months and means this issue has to be pushed down the list, a list that is long and difficult no matter what else the 113th Congress is going to have to deal with.  If there is any low hanging fruit that can be done by executive order, that will be matched by legal challenges in the courts as to implementation and use of the privilege.

It would appear that real progress on the gun issue will probably be done at the state level and then we will see what survives legal challenges.  However, this issue(s) is not going to be solved soon by any means, and yes, there will be addition incidents of gun violence no matter what.

We have already seen what kind of decisions come from some states; are we a country or 50 different countries?

We are a federal system where states have reserved rights under the Constitution, law and court rulings.

Admittedly we have already fought a war as to what is the Union and what remains as to states and local governments, but overall, the idea is that if it isn't illegal under federal law and court rulings, it is legal for states and local to do.  

Case in point, medical marijuana can it be grown and used legally in California, whereas there are drugs laws on the production, use and distribution that appear to trump those of California, Colorado and Washington.  

And yes, there are similarities on what the Federal government would or could do on firearms and explosives as compared to what states of California and New York can and will do as to the  sales, distribution and use of firearms and explosives and what in the end will test as legal. 

According to CA medical marijuana can it be grown and used legally, but the Feds recently raided everything down here and arrested all the entrepreneurs.  The guy in Riverside refused the plea deal based on states rights and just got 7 years, the minimum.  The judge had no discretion but the length of the sentence and there is no parole.

What the hell is Obama thinking?
