Georgetown Law Professor Gary Solis, in his 2010 book The Law of Armed Conflict: International Humanitarian Law in War,[3] wrote: "Assassinations and targeted killings are very different acts".[1] The use of the term assassination is opposed by the authorities, as it denotes murder, whereas people who are allegedly terrorists are targeted in self-defense, and thus it is viewed as a killing, but not a crime.[4]
This professor doesn't mention weapons, but this statement indicates to me that targeting someone (armed or otherwise) is legal as defined by our policies.

It does not matter hoe WE define it. It's all about how the International community interprets it. This is why the SEALs got a lecture, and "don't even think about handcuffing him" wink, from an government-supplied attorney before they embarked on their mission.
Ever wonder why Israel has advised some of its leaders, and military figures to avoid travel to Europe? it's because there are outstanding arrests warrants with their names embossed on them, issued by some of Europe's courts.
So, if the dirt bag was not killed by the first SEAL on the scene, and he did not have a weapon on his person, and his wives were the only people in the room, who delivered the expertly fired slug to his head? Was their another "kill" team on location? Justice might have been done, if a barrel of gasoline were to accidentally spill in that room, with him locked up in a closet and a SEAL decided to take a cigarette break on his way out of the house. Just a passing thought, as I recall my visits to the WTC, in years past, as I know we are better than that.
He had to be killed. Capturing him was never an option.
Slap hand cuffs on him and take him where? Guantanamo? I think not. Max Security in Colorado, I think not.
What would happen? Civil rights be damned, but yes, there would be some that would demand them. But in all truth, if alive, he would have been subjected to any and all of the questionable (read torture) tactics that have been used in the war on terror.
